                      Sub: Contract of Security Arrangements for Air India Housing Colony, Vasant Vihar, New Delhi-110057

           

 

            The Air India Colony Resident Welfare Association invites sealed tenders from reputed parties for provision of specialized Security Coverage to our Housing Colony at Vasant Vihar, New Delhi-110057 (hereinafter called the Housing Colony) on the following terms and conditions :-

 

·         The Party will provide thorough and specialized security coverage round the clock to the Housing Colony thorough deployment of armed and unarmed security personnel who shall be well trained in all security functions.

·         The scope of work will be as per Annexure – ‘A’ of this letter.

·         The General Terms and Conditions of the contract are stipulated in Annexure-‘B’ hereto.

·         The total duration of the contract will be for a period of Three years from 1.9.2010 to 31.8.2013 or for such other extended period, subject to the provisions regarding termination and extension of the contract more elaborately specified in the General Terms and Conditions of the Contract at Annexure-‘B’ to this letter.

                                                                                                     

      Interested parties are required to quote a consolidated rate per month for providing the above mentioned security coverage.  Parties may submit their tenders addressed to the

and drop the same in the sealed box marked “tender for security arrangements in Air India Housing Colony” kept in the maintenance office in Air India Housing

 

 

Colony, Vasant Vihar, New Delhi on or before 8.08.2010 at 1030 hrs.  The AICRWA shall not be responsible for any delay or tender forms sent through the post/courier services.

 

      The sealed tenders received will be opened at 1100 hrs. on 8.08.2010 in the office of the AIRCWA.  Parties who desire to do so, may attend the opening of the tender on the said date, time and venue.

SCOPE OF WORK – SECURITY

1.                   To provide specialized and skilled Security Coverage round the clock to             the Air India Colony situated at Vasant vihar, New Delhi-110057 hereinafter called the Housing Colony) so as to safeguard its bonafied residents, as well as its electrical installations, fixtures, water pumps, Air-conditioners, Water Coolers, Fair Price Shop, Community Centre and any other assets which may be lying inside the premises.

 

2.                   To provide effective Security Coverage at the following points round the clock at the Housing Colony and will ensure that minimum personnel as specified are deployed to prevent and deter the entry of unauthorized personnel and transport, if required by using proper and lawful show of force.

Note:-   Based on the requirement of points as above, the requirement of personnel required for providing security coverage works out to 20 (Twenty) guards and 4 (Four) Supervisors, and evaluation of the financial bids will be based on these figures.

3.                   To provide close surveillance by deployment of skilled and trained personnel so as to prevent and deter theft, pilferage, kidnapping and unauthorized removal of property and material belonging to the residents or to the Housing Colony.

 

4.                   To ensure proper access control in the Housing Colony by checking the entry of the visitors into the Colony and to note down the details of all such visitors in a separate register.

                                                                       

5.                   In case of doubt, to challenge visitors to verify their identity and state their business within the Housing Colony premises and to ensure that any such unauthorized person who has entered the Housing Colony is evicted forthwith, and further to take all necessary steps in that regard.

                                                     

6.                   To search, in case of doubt, the belongings of persons entering or leaving the Housing Colony and to ask them to exhibit all items in their possession.

 

7.                   To carry out thorough check the vehicles entering and leaving the Housing Colony so as to avoid the entry of dangerous/noxious items and to ascertain that they are not bringing in any dangerous/obnoxious material into the Housing Colony, or unauthorisedly taking our property and material from within the Housing Colony premises except under proper authorization.

 

8.                   To carry out intensive patrolling of the Colony Premises and Perimeter Wall so as to ensure that no unauthorized person or transport enters the Colony and that no person lingers therein after his business is completed.

 

9.                   To detect suspicious and/or unidentified items left behind in the Housing Colony premises and to ensure their safe disposal in liaison with the Secretary, Air India Colony Resident Welfare Association (AICRWA) as well as the concerned authorities.

 

10.               To obtain intelligence on any potential activities by any person or persons likely to endanger the peaceful and harmonious living conditions in the Housing Colony and to immediately keep Secretary, AICRWA informed of the same.

 

11.               To prevent and deter any person from constructing any unauthorized structure of shed either within the Colony Premises or adjacent to the compound wall.

 

12.               To check the condition of the compound wall and gates of the building and to advice the Secretary, AICRWA immediately regarding the need to carry out repairs thereto.

13.               In case of any untoward incident, to immediately inform the Secretary AICRWA and to take necessary follow-up action in liaison with police and/or other authorities.

 

14.               To maintain frequent liaison with the Local police and other authorities and to co-ordinate with them in the case of local disturbances and/or any other emergency so as to ensure prompt and adequate protection to the Housing Colony.

 

15.               To inform the Secretary, AICRWA immediately in case any resident of the Colony is found constructing any unauthorized structure, garden etc. within the Colony premises or if any resident is acting in a manner prejudicial to the peaceful, healthy and harmonious co-existence of the residents of the Housing Colony.

 

16.               To implement the above measures with such specialized security equipment as may be prescribed by Secretary, AICRWA from time to time, depending on the prevalent security situation.

 

17.               To assist the Association in the safe evacuation of residents and their properties in case of any emergencies such as fire, flood etc. in any part of the Housing Colony premises.

Annexure ‘B’

 

GENERAL TERMS AND CONDITIONS OF THE CONTRACT

 

1.       DEFINITION

a)         ‘Contract” means the acceptance of the tender and the terms and conditions of the tender form. This tender shall form an integral part of the contract.

 

b)         The term Service Provider shall mean the person, firm or company with whom the contract is entered into and shall be, unless it be repugnant to the context or be specifically specified otherwise, deemed to specify the successors, legal representatives and assigns of the said person, firm or company.

 

     2.    Eligibility:         The Bid prepared by the tenderer shall contain all requisite            information alongwith the documentary evidence in support of the same.      The following eligibility criteria is laid down:

 

a)                   The tenderer must be a firm (proprietorship or partnership)/company/corporation engaged in providing security services).

b)                   The tenderer must have an experience of at-least one year (as on the date of opening of the tender) in Security Services in Large Housing Colony or in a reputed organization (Copy of the contract(s), duly attended by the hiring company/self attested should be enclosed as a proof of above).

c)                   The tenderer must have PAN No./GIR No. & Service-Tax registration No., at the time of application of tender.

d)                   Possession of ESI & PF Registration at the time of application of tender is a must.

e)                   Tenderers who were blacklisted by the AICRWA/ National Aviation Company of India Limited (NACIL) or who had earlier either abandoned any contract awarded by AICRWA/NACIL or refused to accept any contract awarded by AICRWA/NACIL will not be considered.    

 

3.       RATES:

a)         Inclusions: The rates per supervisor and per security guard offered by the tenderer shall be inclusive of all Govt. Taxes/Levies, cost of manpower (including all allied costs such as reliever costs/ extra hour compensation etc.), cost of equipments, provision for uniform and all statutory payments etc.

 

b)         Exclusions: Both Service Tax (including education cess) as applicable would be separately admissible on production of receipt as proof of payment.

c)         The rates agreed to in the Contract shall remain firm for entire contract period including extension and no request whatsoever for further price escalation on any ground will be entertained during the Contract period except as provided in 3(d) below.

 

d)         Provided however that as and when the rates of minimum wages for security personnel are increased by the Government of NCT of Delhi, these rates shall be increased ONLY to the extent of the increase in the minimum wages and the consequent increase in Social Security Costs of PF and ESI.

 

4.       VALIDITY, TERMINATION AND EXTENSION

     

a)         The Contract shall be valid for a period of three years from the date of commencement. AICRWA reserves the right to extend the validity period of the contract beyond the contractual period if and when such contingency arises at the same rates, terms and conditions agreed to at the time of awarding the contract, provided that such an extension shall be for a maximum period of three months beyond the validity of the contractual period.

 

b)         In the event of failure on the part of the Service Provider to comply with the requirement as per terms and conditions specified in this letter, or in case of non-performance or unsatisfactory performance of any part of this contract, AICRWA reserves their right to terminate the contract at the cost and risk of the Service Provider.   Further, the contract can be terminated at any time during the contractual period without assigning any reason whatsoever and without any liability to AICRWA.

                                                     

c)         AICRWA may at any time terminate the contract with immediate effect by giving written notice to the tenderer, if tenderer becomes bankrupt or otherwise insolvent, provided that such termination will not prejudice or affect any right of action or remedy which has accrued or will accrue thereafter to AICRWA.  In the event of termination of the contract by AICRWA under this clause, the service provider shall not be entitled to any compensation whatsoever and the bank guarantee shall be invoked.   

 

5.       RAISING & SETTLEMENT OF BILLS

 

a)                  The Service Provider shall submit his bills in triplicate for each calendar month to the Secretary, AICRWA, Vasant Vihar, New Delhi-110057 in the 1st week of following month and the same will be paid within 45 days from the date of receipt of the bills provided

the bills are found in order.  Together with these bills, proof of payment of wages for the month, deduction and deposit of statutory amount pertaining to ESI, PF should also be annexed for verification.

 

b)         No advance payment shall be made in any circumstances.

 

 

6.       DAMAGES

 

In case of failure to perform or unsatisfactory performance of any part of this contract, AICRWA shall deduct the proportionate amount from the bills due to the Service Provider without prior notice in which case the decision of the Association shall be final and binding.

 

7.       STATUTORY PROVISIONS

 

a)      The Service Provider shall be solely responsible for compliance of all laws, rules and regulations applicable to him, that are promulgated by any Central, State, Local or Municipal Authority regarding the engagement and deployment of Security Personnel, provision of Security Services and the possession, carriage and maintenance of arms and ammunition, as also for obtaining and renewing all required licences/ permissions/ approvals from the concerned authorities. He shall be solely responsible for any cost and consequences on account of any breach and/or non-compliance with any of the provisions of these Laws/Rules /Regulations. 

 

b)      The Service Provider shall be solely responsible for compliance of all laws, including labour laws such as, but not limited to, The Minimum Wages Act, Payment of Wages Act, PF Act, ESI Act, Payment of Bonus Act, Payment of Wages Act, Contract Labour (Regulation & Abolition) Act, Bombay Labour Welfare Fund Act 1953 and all other Labour Acts/Laws as may be applicable to him from time to time. He shall also be solely responsible for compliance with all Civil and criminal Laws of the land and will be solely responsible for any cost and consequences on account of any breach and/or non-compliance with any of the provisions of the Laws/Rules /Regulations including those pertaining to Labour Laws.  The Service Provider shall also be solely responsible for obtaining and keeping current all licences/ approvals/ permissions under all the laws/ rules and regulations promulgated by any Central, State, Local or Municipal authorities, that are or maybe applicable to him from time to time under these laws/ rules/ regulations.

8.       OTHER TERMS AND CONDITIONS

 

a)        The Service Provider shall deploy for this job Security personnel as described in the contract Letter.

b)        The personnel deployed by the Service Provider shall always be his own employees and under no circumstances be considered employees of the AICRWA.

c)         Supervisors deployed by the Service Provider for this job shall hold a minimum qualification of 12th Standard Pass and proof of the same should be submitted to the AICRWA.

d)    The character and antecedent verification by the police, for each security personnel engaged to be obtained at the cost and initiative of the Service Provider and to be submitted to the Secretary, AICRWA.

e)    Any change in number and names of the personnel deployed by the Service Provider shall be informed to the Secretary, AICRWA immediately.

f)     The Service Provider will ensure that the personnel deployed by him are in uniform, punctual, regular, smartly turned out and be medically fit.

g)    The Service Provider will provide equipment/s such as lathi(s) / torch etc at his cost.

h)    All guards shall have a mobile phone at least for reception.  The supervisor in each shift shall have a mobile phone for two-way communication.

i)     The Service Provider shall ensure that the personnel deployed by him maintain good relations with the Association members and the occupants of Housing Colony.

j)     The Service Provider shall deploy his own Supervisor to monitor the work allotted to them on day-to-day basis at respective locations.

k)    The Service Provider shall not subcontract the whole or any portion of this contract to any other party.

l)     The Service Provider shall remove such of his personnel whose presence on the premises is otherwise objectionable in the opinion of the Secretary, AICRWA, Delhi or his authorized representative(s).

m)   No personnel of the Service Provider will be allowed to reside within the Housing Colony.

n)    The personnel of the Service Provider shall not cause hindrance to Air India staff and their family members residing in the Air India Colony premises.

o)    The Service Providers must insure their personnel at their cost against all risks attendant to the job.

p)    The Service Provider shall rotate the security personnel at regular intervals with prior intimation to the Secretary, AICRWA or his authorized representative(s).

q)    The Association reserves the right to add/supplement any further conditions deemed necessary during the currency of the contract to ensure safety and security of the premises.

 

9.       INDEMNITY CLAUSE:- The Service Provider shall hold Housing Colony Association indemnified against any cost/claims, penalties or litigation arising out of any regulations, acts of negligence, theft, fraud, acts of dishonesty and any other activities of omission or commission, whether intentional or otherwise, which may give rise to such costs/claims, penalties or litigation.

Note:

  • The rates per Security Guard and per supervisor offered by the tenderer shall be inclusive of all Govt. Taxes/Levies, cost of manpower (including all allied costs such as reliever costs/ extra hour compensation etc.), cost of equipments, provision for uniform and all statutory payments etc.

Undertaking:

1.        The Financial Bid will be valid for 3 months from the date of issue of contract.

Madam,

           

Air India Colony Resident Welfare Association has decided to initiate the process of re-tendering in respect of security arrangement in Air India Housing Colony, Vasant Vihar, New Delhi. Re-tendering for security arrangement has become imperative, as cases of theft, encroachment, entry of anti-social element have multiplied in the recent past, whereas the existing contractor has failed in providing secure environment to the colony. It has also been decided that against the existing provision for providing 24 security guards  presently deployed under two separate contracts of NACIL (I) and NACIL (A), we would be seeking one shift supervisor in each shifts( total two supervisors)

 

 Though, fresh tender had been invited in the month of January 2009, for security arrangement, the finalisation of the contract and subsequent award to L1 took  long  time due to difference of opinion among the competent authorities in the Association, as a result of which, L1 withdrew the offer of  acceptance.

 

Keeping in view the urgency of providing secure environment, Association has decided to initiate the process of re-tendering at the earliest and finalise the contract within a time-frame, the tender document, work scope in respect of providing security arrangement in the colony, and other Terms and Condition are being enclosed for your perusal. It is requested that the enclosed Tender for Security Arrangement in Air Indian Housing Colony, Vasant Vihar may please be hosted on the NACIL website for better circulation. 

 

An early action in this regard shall be highly appreciated.
